Kirk F. Lapple is a civil law attorney representing individuals and businesses in a variety of cases including negligence, personal injury, business disputes, breach of contract, real estate, malpractice (medical, dental & legal) and selected family law matters in both litigation and non-litigation contexts.

 A TIP if you are in an automobile collision:  1) Take cellphone pictures at any accident scene including all vehicles involved if you are able; 2) Do not give a statement to the other driver's insurance company or your own until you have consulted with this office; 3) Take photographs of your vehicle before it is repaired; and 4) Take photographs of any visible physical injuries you may have.

Notable Cases

 

Doherty v. Liem DDS - (Defense case).  Mr. Lapple was representing a dentist being sued for alleged malpractice including negligent root canals and crown placement.  Judgment for defense on all causes of action.  Plaintiff recovered no monetary damages.

 

Eric A. v. Hermon Equiptrans - A plumber on his way to a job was rearended on the freeway by a loaded semi-tractor trailer.  He suffered serious injury to his spine including a 7mm herniated disk for which surgery was recommended.  $210,000 settlement.

 

Billie H. v. Home Town Buffet - Plaintiff, a senior citizen suffered a fractured hip after tripping on a child's high chair protruding into a main aisleway in the restaurant.  $165,000 settlement.

 

Leona L. v. Universal Studios Hollywood - Plaintiff claimed chest injuries while riding the Jurassic Park water flume ride.  Settlement confidential.

 

Borba v. Universal Studios Hollywood - Plaintiff claimed a fractured sternum while riding the Jurassic Park water flume ride.  Resolution confidential.

 

Pittman v. United Wheel Techs; United Wheel Techs, Inc. v. Surface Tech, Inc. (and related cross actions) - Multifaceted dispute (including alleged trade secret misappropriation) between former shareholders in a family business.  On behalf of the defendants/cross-complainants, Mr. Lapple obtained judgment for the defense and an award of attorney's fees and costs of $159,504.40.  In addition, Mr. Lapple obtained a court order forcing Surface Tech, Inc. to remove its website from the internet which as a practical matter shut down its business.

 

Todd and Marcia D. v. Los Angeles Department of Water and Power, J. Fletcher Creamer & Sons - An action for damages caused by alleged negligent replacement and maintenance of a water meter and residential electrical supply lines which caused a phenomenon known as "stray electrical current" to start a fire in the family home resulting in property damage.  Mr. Lapple obtained full compensation for the plaintiffs' property damage of $14,343 and attorneys fees of $12,487.50. 

 

Alfred M. v. Jahangiri DDS - Claims of negligent dental implant surgery resulting in mandibular and lingual nerve damage with numbness.  $55,000 settlement.

 

Kevin C. v. Liu DDS - Claims of negligenct dental implant surgery resulting in manidbular nerve damage with numbness.  $60,000 settlement.
